Terms of Service

Effective Date: August 7, 2026
Brand: Truestco

These Terms of Service govern your access to and use of the Truestco website, products, and services, including custom furniture design, Second Quote consultations, and made-to-order furniture purchases. By placing an order or using our services, you agree to be bound by these terms.

1. Order Acceptance & Pricing
- All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, pricing errors, or suspected fraudulent activity.
- Our pricing follows a transparent, fixed 15% profit margin model. Prices are listed in USD and do not include taxes, duties, or shipping fees unless explicitly stated.
- Quotes generated via our Second Quote tool are preliminary estimates; final pricing and specifications are confirmed only upon formal order acknowledgment.
- We may update product prices at any time without prior notice, but confirmed orders will be honored at the price stated at checkout.

2. Payment Terms
- Full payment is required at the time of order placement to initiate production.
- We accept major credit cards, PayPal, and eligible installment payment plans. All payment processing is handled by authorized third-party providers; we do not store full credit card details on our systems.
- For custom projects requiring multiple phases, payment milestones will be outlined in your formal order agreement.

3. Production & Delivery

- All our furniture is made-to-order. Standard production lead times are estimates, typically ranging from 4 to 8 weeks depending on product complexity and material availability.
- Delivery is provided via white-glove service for all large furniture items, including inside delivery, assembly, packaging removal, and placement in your room of choice.
- Delivery dates are estimates and not guaranteed. We are not liable for delays caused by manufacturing, shipping carriers, customs, or other circumstances beyond our reasonable control.
- A valid contact person must be present at the delivery address to accept and inspect the shipment.

4. Custom & Made-to-Order Products
- Products with custom dimensions, fabric selections, wood finishes, or other personalized modifications are considered custom made-to-order items.
- It is your responsibility to verify all specifications (dimensions, materials, finishes) before final order confirmation. We are not responsible for errors in customer-provided measurements.
- Custom made-to-order items cannot be canceled, returned, or exchanged for non-quality reasons once production has begun.

5. Warranty
- All Truestco furniture is backed by a 10-year structural warranty covering defects in materials and workmanship for the hardwood frame, spring system, and core structural components.
- The warranty is valid for the original purchaser only and applies under normal residential use. It does not cover normal wear and tear, accidental damage, improper assembly, misuse, modifications, or commercial use.
- Consumable components such as foam cushions, fabrics, and finishes are covered by a 1-year limited warranty from the date of delivery.
- Full warranty terms and claim procedures are detailed in our Shipping & Warranty Policy.

6. Intellectual Property
- All content on our website, including product designs, images, text, graphics, logos, and the Second Quote tool, is the property of Truestco and protected by U.S. and international copyright and trademark laws.
- You may not reproduce, distribute, modify, or use any of our intellectual property for commercial purposes without prior written permission.
- If you submit design references, photos, or ideas to us, you grant us a limited license to use those materials to fulfill your specific order.

7. Limitation of Liability
- To the fullest extent permitted by law, Truestco shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or services.
- Our total aggregate liability under these terms shall not exceed the total amount paid by you for the specific product or service that gave rise to the claim.
- Nothing in these terms limits or excludes liability for personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

8. Modifications to Terms

- We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page.
- Your continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.

9. Governing Law & Dispute Resolution
- These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
- Any disputes arising from these terms shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
